Distance Selling Agreement

1. Parties

SELLER: Company: SkipperDesk Email: sales@skipperdesk.io Website: https://skipperdesk.io BUYER: The user who purchases a subscription through the Platform. Buyer information is the information provided during registration.

2. Subject of the Agreement

This agreement regulates the rights and obligations of the parties regarding the sale and delivery of the SkipperDesk maritime management platform subscription service offered by the SELLER to the BUYER electronically, in accordance with Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

3. Service Features

SkipperDesk is a cloud-based maritime management platform. Services included in the subscription: • Vessel management and tracking • Crew and personnel management • Financial management (cash, expenses, fuel tracking) • Voyage planning and management • Maintenance tracking and planning • Reporting and analytics • Document management The service can be accessed from any device with internet access through a web browser.

4. Service Fee and Payment

Subscription plans and pricing: • Vessel Plan: €100/month or €1,000/year (tax included) • Fleet Plan: €150/month or €1,500/year (tax included) • Additional vessel (Fleet): €75/month or €750/year Payments are made by credit card or debit card. Payments are automatically collected monthly or annually based on the selected plan. All prices include applicable taxes.

5. Service Delivery

The service is made available electronically immediately after payment confirmation. There is no physical delivery. Upon payment confirmation, the user gains instant access to all features within the subscription scope. All features are available during the 30-day free trial period. If a paid subscription is not activated after the trial period, access is restricted.

6. Right of Withdrawal

In accordance with Article 50 of Law No. 6502 and Article 15(ğ) of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for services that are immediately performed electronically and for digital content delivery agreements, provided that the consumer has given consent to begin performance. The BUYER acknowledges that by purchasing a subscription and beginning to use the service, they waive their right of withdrawal.

7. Subscription Cancellation

The BUYER may cancel their subscription at any time: • Through the "Account Settings" section in the Dashboard • By sending an email to support@skipperdesk.io Cancellation takes effect at the end of the current billing period. Full access to all features continues until the end of the period. No partial refunds are issued for unused periods.

8. General Provisions

• The BUYER acknowledges that they have confirmed the Pre-Information Form electronically. • This agreement enters into force upon confirmation by the BUYER. • Consumer Arbitration Boards and Consumer Courts have jurisdiction over disputes arising from this agreement. • The SELLER processes the BUYER's personal data within the framework of the Privacy Policy and KVKK Disclosure Notice.

9. Dispute Resolution

For disputes arising from this agreement, Consumer Arbitration Boards have jurisdiction up to the value announced by the Ministry of Commerce, and Consumer Courts have jurisdiction for disputes exceeding this value. Governing Law: Laws of the Republic of Turkey.
